Applying for Consent Orders - What you need to do

Consent orders are orders that you and your spouse agree on. These orders are lodged with the Court. You do not need to attend a hearing. Consent orders have the same legal effect as if they had been made by a judicial officer after a court hearing.

  1. Complete an Application for Consent Orders
  2. Prepare an Application for Consent Orders.

  3. Prepare the Terms of Settlement
  4. These must be prepared in accordance with the supplement.

  5. Make 2 copies
  6. Make two photocopies of the completed and signed Application for Consent Orders and Terms of Settlement.

  7. Lodge it at a Family Law Registry
  8. You will need to lodge the original and the two photocopies of the Application for Consent Orders and Terms of Settlement plus a copy of either your Marriage Certificate or Divorce Certificate at a Family Law registry. There is an $80 court fee for consent orders.
