Applying for Consent Orders - What you need to do
Consent orders are orders that you and your spouse agree on. These orders are lodged with the Court. You do not need to attend a hearing. Consent orders have the same legal effect as if they had been made by a judicial officer after a court hearing.
- Complete an Application for Consent Orders
Prepare an Application for Consent Orders.
- Prepare the Terms of Settlement
These must be prepared in accordance with the supplement.
- Make 2 copies
Make two photocopies of the completed and signed Application for Consent Orders and Terms of Settlement.
- Lodge it at a Family Law Registry
You will need to lodge the original and the two photocopies of the Application for Consent Orders and Terms of Settlement plus a copy of either your Marriage Certificate or Divorce Certificate at a Family Law registry. There is an $80 court fee for consent orders.
