The Court

There are three courts that look after family law - The Family Court, the Federal Magistrates Court and the Family Court of Western Australia.

If you live in Western Australia and/or your case may occur in Western Australia then your court is the Family Court of Western Australia.

For the rest of the country it is the Family Court and the Federal Magistrates Court. Together they are known as the Family Law Courts and together they operate the Family Law registries. It is here that you file documents including your Application for Divorce.

Generally speaking the Federal Magistrates deals with the less complicated matters (including divorce applications) while the Family Court deals with the more complicated matters (including parenting cases with serious child welfare issues and financial cases involving serious money).
